Recently, I was approached by a record company. They wanted to use my Mike Davis artwork for one of their CD/album covers. I rejected the offer because I wasn't sure if I have any rights to give them the okay to reproduce the imagery even though I own the artwork. What rights do I have as an owner of a original artwork?

What rights do I have as an owner of a original artwork? you have no rights unless i'm seriously mistaken. artist keeps all rights to his work even if you own the OG. i was also approached in the past coincidentally to use some luke chueh images but i told them to ask luk.

Correct copyright is based on the image not the piece, you would have no right and may find yourself having problems along with the band. best to direct the band to the artist

that is correct. you as as the owner of original (og) art have no third party rights to to resell for commercial use/profit, even though you now own the art. what you bought by purchasing the og or print(s) for that matter are for "hanging rights only" as all copyright is held by the artist/estate. you could, if you knew how, contact the artist direct and pass along the music companies contact info and the artist (or artist agent/rep) could possibly negotiate a re-use fee for usage/licensing those rights for the CD/albums cover. Who know's the artist may be so thrilled (as they now have "found money", always a good thing) that you to could benefit from the transaction. I'm not a lawyer, but am familiar with the subject. it's very cool though and exciting to think you bought a pc worthy of such attention

Completely agree with isthatchicken. I bought a Donovan Crosby painting and saw an ad in Juxtapoz a couple of months later with the image. Of course, I was pleased to see my painting, but I was curious. Verified the same thing - the rights to the image remain with the artist as their intellectual property.

I know the feeling, my Andrew Schoultz painting was in the Arrow magazine and in his book from Parklife.
